The USTR has been active over the last couple of months in granting exclusions and extending certain exclusions that were scheduled to expire. USTR continues to seek comments from industry to determine its next steps. This blog is a snap-shot of the USTR’s comment and exclusion request docket. Currently USTR is seeking comments on the Enforcement of U.S. WTO Rights in Large Civil Aircraft Dispute and China Section 301 Product Exclusion Extensions. Here is the breakdown:
ENFORCEMENT OF U.S. WTO RIGHTS IN LARGE CIVIL AIRCRAFT DISPUTE
- Status: The USTR Comment portal for submitting comments relating to this review is now open. The deadline for comments is July 26, 2020 at 11:59PM.
- Comments are invited with respect to the maintenance or imposition of additional duties on specific products of specific current or former EU member States. 32 products of France, Germany, Spain
or the United Kingdom are under consideration for increased duties.
CHINA SECTION 301 PRODUCT EXCLUSION EXTENSIONS
- List 3: Comments Concerning the Extension of Particular Exclusions Granted Under the April 2020 through May 2020 Product Exclusion Notices
- Status:
- June 8, 2020 – Portal Opens to Submit comments
- July 7, 2020 – Deadline to submit.
- Why Comment?
- Certain exclusions granted for List 3 are scheduled to expire on August 7, 2020. USTR wants to hear from you on why USTR should grant a possible 12-month extension for these specific exclusions.

- List 1: Comments Concerning the Extension of Particular Exclusions Granted Under the September 2019 Product Exclusion Notice
- Status:
- June 8, 2020 – Portal Opens to Submit comments
- July 7, 2020 – Deadline to submit.
Why Comment?
Certain exclusions granted for List 1 are scheduled to expire on September 20, 2020. USTR wants to hear from you on why USTR should grant a possible 12-month extension for these specific exclusions.
