Here is a recap of the latest customs and international trade law news:

Courts  

  • The Court of International Trade (CIT) denied the government’s motion for a stay of enforcement of the court’s ruling against Section 122 tariffs and its order for an injunction against collecting Section 122 duties from the plaintiffs. 

Customs and Border Protection (CBP)  

  • CBP updated its CAPE FAQ page with several new questions and answers, including guidance on whether importers should file with the Court of International Trade, how interest is calculated, and what the agency is doing to prevent fraud.  
  • CBP announced new interim measures on several importers for the evasion of the AD/CVD duty orders on golf carts from China. 
  • CBP found reasonable suspicion that ICON EV, HDK Plastic Factory, Denago EV Corporation, Aero Import, Tao Motor, and Marxon had been entering covered merchandise from China through transshipment via Vietnam and misclassification. In a separate notice of investigation, CBP imposed the same requirements and had similar findings with Star EV Corporation. 
  • CBP announced new interim measures on Dymatec USA for evading an antidumping duty order on diamond sawblades from China.  
  • CBP announced new interim measures on several importers for evading antidumping duty and countervailing duty orders on seamless carbon and alloy steel standard, line, and pressure pipe from China by transshipping the pipes through Thailand. 

Office of Foreign Assets Control (OFAC)  

  • OFAC announced a $275M settlement with an India-based company to settle its potential civil liability for 32 apparent violations of OFAC’s Iran sanctions. 

Department of Justice (DOJ)

  • Two Canadian steel companies, along with their president, agreed to pay $19 million to settle allegations that they violated the False Claims Act by evading duties on flat-rolled steel from Europe and Asia. 
  • Four of the world’s largest shipping container manufacturing companies and their executives were indicted for conspiring to restrict the output of standard unrefrigerated shipping containers. The conspiracy doubled the prices of standard shipping containers between 2019 and 2021. 

Federal Maritime Commission (FMC)

  • The Senate voted to approve a package of President Trump’s nominations, including attorney Robert Harvey to be a member of the Federal Maritime Commission. 

Food and Drug Administration (FDA

  • The U.S. Food and Drug Administration (FDA) announced that it is piloting one-day inspectional assessments. These assessments will be shorter, more focused, and will complement existing standard FDA inspections.  
  • The FDA launched a new importer resources page on its website, providing central access to educational materials, guides, and an index for importers and brokers navigating FDA requirements. 

Congress

  • Several members of Congress wrote a letter to U.S. Trade Representative Greer urging him to make several improvements to provisions of the USMCA, including combatting offshoring jobs, environmental standards, and forced labor.  

Industry News 

  • The National Association of Manufacturers issued a report on the review of USMCA. The report emphasized the need for duty-free imports of energy and critical minerals to support U.S. industry.  

International  

  • The European Council and the European Parliament reached a provisional deal that would clear the way for final adoption of regulations to eliminate the EU’s remaining customs duties on U.S. industrial goods, as agreed upon in the EU-US trade deal from August 2025.
