This week’s recap of the latest customs and international trade news: 

Customs and Border Protection (CBP)        

• CBP filed an update with the CIT in the IEEPA refunds case, stating that nearly $130 billion in potential and certified refunds have been accepted for processing via CAPE, and over 5 million entries failed entry level validations. 
• CBP issued guidance via CSMS message regarding how to electronically remit payment for increases in duties, taxes and fees from a post-summary correction. Filers will not be able to pay in check or cash beginning Aug. 5. 
• CBP officers from the George Bush Intercontinental Airport seized nearly $4 million in counterfeit goods, including fake MLB and Nike apparel, Louis Vuitton bags, Cartier sunglasses, and Jaguar Land Rover computer systems.

Courts      

• A group of 25 states led by Oregon, Arizona and California filed a lawsuit at the CIT challenging the Section 301 forced labor tariffs as a violation of the Administrative Procedure Act, alleging that USTR’s investigation was rushed and failed to address comments.  
• Customs broker Forrest Xu filed a complaint with the CIT arguing that CBP deactivated his broker entry filer code without due process.

Administration:

• President Trump issued a Proclamation establishing an incentive for companies that are expanding primary aluminum production in the US, allowing them to import primary aluminum at a reduced tariff rate. 
• On July 20, 2026, the White House announced that the United States will impose an additional 50% tariff on many Canadian-origin products beginning 30 days after the order’s issuance.  
• President Trump announced via Truth Social that the Administration will initiate a 301 investigation into the European Union for excessive fines against American tech companies. 
• President Trump announced via Truth Social that effective August 1st, 2026, all Generic Drugs being brought into the United States will continue to have a 0% tariff for a two-year period of time, after which the tariff will be raised to 100% for one year, and 200% thereafter. 

United States Trade Representative (USTR)  

• On July 23, 2026, the USTR announced a Section 301 action imposing new tariffs on 60 trading partners.

Administration: 

• President Trump signed a Proclamation temporarily removing duties on phosphate fertilizer from Morocco. The duties will be suspended for eight months. 

Customs and Border Protection (CBP)      

• On June 29, 2026, CBP launched CAPE Phase II for IEEPA refunds. This phase covers enhanced processing for reconciliation-flagged entries, making the large majority of IEEPA duties eligible for refund.  
• CBP issued an interim final rule (IFR) that codifies the suspension of de minimis for international mail shipments and establishes a new postal informal entry process for certain goods entering by mail. The rule takes effect July 24, 2026. 
• CBP issued a Notice of Determination as to Evasion in an EAPA case, finding that a major solar-module importer evaded antidumping AD/CVD orders on crystalline silicon photovoltaic cells.  
• CBP published a Federal Register Notice increasing interest rates for underpayments (7% for both corporations and non-corporations) and overpayments (7% for non-corporations and 6% for corporations).

Another busy month in international trade news. Here is a recap of what happened this month.

Administration  

• On June 3, 2026, President Trump signed an Executive Order that aims to strengthen customs enforcement. The order increases bonding and data requirements for IORs, prohibits foreign importers from filing informal entries, requires additional documentation and certifications from importers, among other requirements.  
• On June 1, 2026, President Trump issued a Proclamation providing 232 tariff reductions for agricultural equipment, mobile industrial equipment and machinery, and heating, ventilation, and air conditioning equipment. The reductions take effect June 8, 2026.  

Courts    

• On June 2, 2026, the United States filed an appeal of the Court of International Trade’s April 17 order directing CBP to refund duties imposed under the International Emergency Economic Powers Act (IEEPA).  
• A group of law firms filed an amicus brief with the CIT in the Euro-Notions Florida IEEPA case, arguing that the CIT should amend its refund orders to account for businesses and individuals who indirectly paid duties imposed under IEEPA.

Administration

• During a conversation with a reporter, President Trump said that he would “rather not have the USMCA” and that he would prefer “not having an agreement, but I’m open to doing it.” 
• In an interview with the New York Post, President Trump threatened a 100% tariff on all champagnes and all wines coming out of France if the country does not drop its Digital Services Tax on U.S. companies.  

Courts

• A group of law firms filed an amicus brief with the CIT in the Euro-Notions Florida IEEPA case, arguing that the CIT should amend its refund orders to account for businesses and individuals who indirectly paid duties imposed under IEEPA. 
• The Supreme Court denied a petition to appeal the U.S. Court of Appeals for the Federal Circuit’s decision upholding lists 3 and 4A Section 301 tariffs on China imposed during the first Trump Administration.
